If your hard drive is bad and there is no way to recover your data, and you don't have any backups anywhere of your songs, you have lost them for good. Apple does keep track of what you have purchased, but I doubt they will let you download the songs again for free. I guess emailing them about it wouldn't hurt, but I still doubt they will let you download your songs for free. If you don't have any backups and you choose to download from apple, make sure you make backups to a stable medium outside of your computer.
