My best friend is getting married and her fiance asked his 14 year old brother to be the best man. But it brings up a question does the best man have to be a legal age since he has to sign as a witness on the marriage liscense?

The best man can be any age. I don't know of any state that requires that the best man sign as a witness, only that "a" witness sign. If the witness has to be of legal age, just have someone in attendance other than the best man sign.
The best man can be any age but I'm not sure if he can sign the marriage license or not. But any "witness" can sign it, it doesn't have to be the best man, that is just tradition. The only other problem with having a minor as the best man is that they duty of throwing an awesome bachelor party will have to be delegated to someone else. But its sweet that he wants his younger brother to be the best man!
