what type of law is this please?

Question

i may be forced to sue an exfriend for money i loaned to him and his husband. total is around a hundred bucks. i know not alot of money. but in this economy it is and i need it back. 

the agreement was verbal i know that was a mistake. he agreed o pay me back the following friday. the money was  loaned on valentines day. so its been almost 2 months. since.  he already owed me 20 from a past loan. i honestly thought he was good for it. the friendship fell apart the same weekend over something unrelated. which is a different legal matter. as a result i feel i need to get my money so i can sever all ties so what kind of lawyer do i need and how do i file.

If you're planning on hiring a lawyer to recoup $120, that may not be the best idea you've ever had. Do you have any idea what attorneys charge? They typically get 40% of any settlement you get so it would be a waste of time for  both of you. If you want to pursue this just for the principle you need to file suit yourself in small claims court.

Verbal contracts hold in most states, but usually only if you have an independent witness.  If it simply comes down to your word against his then you may not be able to collect your money if you have no proof.  Its a small claims court or tort law issue.

Small claims, no lawyer, little chance of getting it back. Better to write it off as a off line learning course on money management.  Oh yes, write them off as well.
