Do you legally have to take the inside lane and then move over one lane at a time , or can you take the outside lane since there is no traffic coming ?

legally inside then outside. One lane at a time. That is, unless your turn is less than 100 ft away.

moscowca is correct with the exception if there are two right hand turn lanes, then you must take the corresponding lane. Not every place has them.
