Your question is a bit unclear. Did the guy come for his car while the wrecker was there and moved it then? Did you have it hauled someplace and if so where?

You probably needed to send him a certified letter telling him to remove it by a certain date or it would be towed at his expense and you needed to have the green receipt card returned. Then you could have contacted the police about an abandoned vehicle and had it towed to an impound lot.

So how did the guy know the wrecker was there or coming out? Could the car be driven? Did you have a key?

I'm assuming you are in a residential area and not a commercial car repair.

It depends on the state as well. It depends on whether the car is registered and licensed.

You don't say but you probably got stuck with the wrecker bill since they were called out. That is probably why you are writing. So how did he get his car home? If you gave proper notice to him to move it, it might have been better to call police on the car as an abandoned vehicle and see if they would deal with it. Police may let a guy take his car rather than allow you to haul it away. We don't know enough about the circumstances on the pick up of the car and why the officer chisento do what he did. They don't always know all laws and details as judges determine that.

You can't just sell his car to a junkyard if that is what you were trying to do. You would have to get a court order to do that. You would have to have title through court for an abandoned property or claim it because he owed you money.

Next time get money for repairs up front and don't deal with this guy again. If it happens, talk to police about how to get it off your property legally. Notices must have a future deadline for removal and be sent certified mail with a return receipt confirmation or hand delivery with you putting notarized statement as to delivery. Proof of delivery if notice.

Hope you are not out too much. If you did any wirk on it and agreed to pay you, then take him to small claims court to recover costs. You could try that fir wrecker fee if you gave him good notice.
