Divorced Parents Disagree About Homeschooling?

I was wondering if anyone has any advice on dealing with this kind of situation.  My step-brother has been divorced for years now but has been actively involved in his sons' lives.  Goes to all their school events, has them every other weekend/holiday... is just extremely involved in their lives but of course... he doesn't have full custody.

Now... his ex-wife just randomly pulled the kids out of school this week (they are 11 and 9) as well as her other two step-children so that she can home-school them because there are drugs and alcohol in the world... which is actually rather funny because she drinks and smokes pot.  Anyway... this woman, who never finished high school and can't even get along with her oldest son and has sent him to my step-brother on many occasions because she can't control him, has decided that homeschooling is the best thing for the kids.

Is there a chance that the courts will rule in favor of public schools?

I hope the courts will rule in your step brother's favor. I'm a teacher and frequently we get students in the 5th-8th grade who are just coming into the public school system. The majority of them are so far behind they get discouraged because they see how they measure up with the other students and can barely see the light at the end of the tunnel. I have also seen students who have had excellent home schooling and there are advantages to it but only when the 'teacher' is qualified to actually teach the children.

Tell Your step brother to find evidence about she smoking pot and drinking heavily take the kids to therapy they are 11 and 9 if she refused ask the court that you are very concern about what's going on with the kids they will force her to do it and of course they will rule in favor of public schools

You said two useful words, "smokes pot".  If you are a hundred percent sure she does smoke marijauna and she doesn't have a medical prescription for it, report her anonymously to CPS (use a pay phone) or turn her into the police. If she is convicted of drug possession or illegal drug use, your step-brother can use that to get custody of his kids and then he can put them back into school.  Otherwise, he must get himself a very good lawyer and get statements from all the children's teachers.  Then he has to fight for custody based on his ex removing the children from their schools.  He has a 50-50 chance of winning custody on those grounds but if he can get her busted for drugs, he should win hands down.  Take care.

You need to see a lawyer asap.......just because he doesn't have full custody doesn't mean he doesn't have rights.

Ive never agreed with homeschooling...how can the average person 'teach' everything a child needs to know. Homeschooling is not very well known in Australia, not many people do it at all....

Get them back in school , its the best option. How can a woman who never even finished high school be equipped to teach children ................Teachers have university degrees, to teach our kids.

Your step-brother will need to take her back to court.  One parent cannot arbitrarily make decisions like this, against the wishes of the other parent.
