I am recently divorced and have changed my and my children's address with our hospital and clinics. My EX husband and are are in the process of sorting though the kids medical bills so we can each pay our share (they're in collection). However, the hospital/clinic not only sent our children's medical records to my EX, but MY records as well.
How do I report this violation and to whom? What will happen?

you can call their advocacy line, BUT i dont think they did it on purpose.... people make mistakes..
i'm a scientific biller ( 10 years of scientific journey) and a junior in wellbeing administration.i do no longer understand if a lost chart actual may well be a HIPAA violation. that's continuously achievable that that's interior the place of work and purely no longer the place that is going to be, i might think of that clerical errors like this does not be a HIPAA violation. something that become actual carried out intentional or if the chart become taken outdoors of the place of work and lost then i might think of it may well be a HIPAA violation. desire this helps some.......
Did they send the medical RECORDS or the medical BILLS? The two are different. I'm going to assume you meant they sent the BILLS.
I don't know about your clinic, but mine has the entire family on one account. I believe (not sure, though) they base it on the insurance. Since everyone is on the same insurance plan, it all goes on the same account. They then send the statement with the amount we owe for deductible and copay on a single bill, and everything is itemized. It does not go into details, but it does list office visits, lab work, and any supplies needed.
I don't think it has to be a willful violation to be a violation. If you were still married your husband would have to have a release to get your information. I would be screaming mad!
