Can we sue for harassment?
My husband's ex-wife keeps calling CPS on us because he filed for full custody of their 11 y.o. daughter. CPS always clears us of all allegations. Can we sue her for harassment?

sue for what? have you lost any financial compensation or other forms of money because of this? if not, theres nothing to sue for......in order to sue someone you have to have lost some form of money.....you cant sue for money that you havent lost just because shes harassing you. so, no i would say that you cant sue....well.... you could but you probably wouldnt win.

This is an important piece of information that you need to keep with you until death; You CANNOT sue a person if you cannot prove a financial loss caused by the person. Her texting you is not causing you to lose anything financially so you would not be able to sue. No you would not be able to get a restraining order. Restraining orders are when you are in imminent danger of being harmed by a person. Simply being harassed through texting is not considered a physical danger to you. Your best route is after you change your phone number, if she gets that number to call the police and file a complaint with them. Harassment is a criminal offense. It just depends if it is considered an actual case of harassment. What you need to do now, and what the police would tell you to do now is to change your phone number. James G - They do not pass them out like candy and it is actually very difficult to get a restraining order.

consult a lawyer, have all documentations of CPS visits..you will need documentations from CPS..must go through the courts to obtain such things..

no.... lol u can file for a restraining order but theres nothing to really sue about god to many people want to sue for nothing nowadays
