First off, the IRS doesn't call it that anymore. (That doesn't stop all the people who knew by the old name from asking for it.)
It's now called a "verification of non-filing letter" and is only issued when the IRS is fairly confident that you do not have a filing requirement. The 2009 letters can be requested after June 15th, by then the IRS has access to all W-2s and 1099s the received from payers.
To request the letter, use form 4506-T.Option 7.
