so im getting a promotion and it comes with a car and a phone he says that he wants to have gps on them both so he knows im not abusing them i totally understand the car but not the phone he doesnt need to know where i am on my time he can already see who i call and stuff so i dont see the point i understand im on call 24/7 but he doesnt need to know where i am how do you guys feel and is this even something he can do

Sounds like this guy has been burned in the past. Assuming this is a promotion, you already work there -- so I would open a conversation and gently inquire about why he feels the need to require this. Assuming you already have a car, and a cell phone of your own already - agree on what the terms of the use of the company property are - don't just assume - and couch it in that you want to be crystal clear on the guidelines as you want to make sure you do not unknowingly violate any rules or guidelines. Use your work phone and work car ONLY for work - and use your personal phone and personal car for personal use only - keep GOOD records if you DO ever use the work equipment for personal use, as that would be personally taxable. Usually at a minimum if you drive it to work, and drive it home -- that will be taxable income to you in addition to taxes on your salary, etc. Go talk with HR and payroll and see what this entails for you cost wise --- depending on the field/profession it could be cheaper for you to negotiate more salary in lieu of the car, and agree to specific hours you will answer the phone/be available for work calls -- and guidelines for it's use. A company cell phone or blackberry can become a leash from which you can never get free off, AND you can also become a blackberry addict who never turns the thing off,
