Can I get a accident liability release form if we settle out of court ?

i got into a car accident and told the other person I'd pay out of my pocket, I was wondering if I can get them to sign a liability release form since even if we settled out of court . thanks

But you could also write on the memo section of the check, or the back of the check above where it would be endorsed: "Full payment for collision from DATE OF COLLISION." The copy of the cancelled check (which you can get after they deposit the check) would be your signed agreement.

Actually Artemis is correct, and her answer makes the most sense. Hiring an attorney for something like this is overkill, and not necessary. Since the recipient is signing the check, the canceled check will serve two purposes - a signature acknowledging acceptance of payment in full and proof that payment was made.

I would absolutely make it a condition of settling. Don't give him a dime unless he signs away the right to sue you again for this. Your attorney can get the paperwork together for that.

Teekno is correct, you SHOULD have an attorney draw up a release.
