Friend's ex threatening to not let him see his son...?

My friend was with this girl for a cpl of years and she left him about a year ago. They have a lil boy together. Well she left him to be with some crack head (this is his account, I do not know her so I am not for sure this is fact or not). Well recently after being seperated for a year he has started dating another girl. The mom has flipped out and now tells him since he is seeing her he can not see his son until something is set in stone through the court and then tells him that he is not the father and that she will have DNA testing done to have him removed from the lil boys birth certificate. First of all, he has been in the boys life since day one and since they seperated has been paying her and had insurance on the boy. So if he is not the biological father, he is the only father this lil boy knows. Is she able to do that. And secondly since she has been receiving aid and child support and he has paid for insurance on the lil boy and knew (for what she says) that he is not the father and it turns out the he is not isn't that fraud against him and the state? Would he have any legal rights to the boy since he's been the father figure for 3 years? All in all I know she is just being vindictive to him bc that boy is his life and in the end all it is going to do is hurt her son. I just wish she would see it that way instead of doing it to just be hateful to his father.

Just an addtional comment. I am not dating this guy...lol sorry if it came across that way. Just trying to get a lil bit of advice for a long-time friend of mine and my husband's.

he needs to see a lawyer and get this straighten out. because with all of this gong on he needs legal help.. if she went away that means that she deserted him. and especially if she went with a coke head. that would make her a unfit mother. I don't know how a judge would see it but I would say she don't have any right to say who your friend is seeing or doing because she walked away and left the little boy.in any case if he was taking care if this child all of this time he might be awarded custody of the child. but I would strongly advise him to get a good lawyer. and it seems wrong too for her to get child support and not take care of the child either.

He can file for custody. He is on the birth certificate and is just as much the father as an adoptive parent or step parent or guardian would be. File for custody and visitation.

First you would need to find out for sure if the child is his. If it is then she has no right to deny him his child and if what he is sayin is true about the drugs he can file for sole custody. However if its not she will be held respondable for all the money he has put forwared towards the child. Good luck
