You need to start with HR. If they do not resolve the issue then you go to the EEOC

First HR but you will have to have all your facts in order because they will open an investigation. It has been my experience that you should look at problems from multiple angles and never just assume discrimination first. Have you discussed this claim with your boss first? HR will ask..
