Does the fact that a person can get 2 counts of murder for killing a pregnant woman confuse anyone else?

If the unborn are "not people," how is it that this could happen? People kill the unborn all the time, either they're people or they aren't. If they are, how is it that abortion is still legal?

The only difference is that one is wanted and one is not. Which, by the way, is a very sad commentary on how some people define a "person." Would any of the pro-choice folks here be willing to go tell any unwanted child that they aren't a person because they aren't wanted?

Just Me....The Unborn Victims of Violence Act of 2004 (Public Law 108-212) is a United States law which recognizes a child in utero as a legal victim, if he or she is injured or killed during the commission of any of over 60 listed federal crimes of violence. The law defines "child in utero" as "a member of the species Homo sapiens, at any stage of development, who is carried in the womb"

I guess one of the 60 crimes is not setting out to kill them specifically. Wow.

Most states (about 38) have fetal homicide, also known as feticide, laws. Of those, 23 consider the killing of an unborn child, at any point of its development, during the commission of another crime to be a homicide. Therefore, if the mother also is killed, there would logically be two counts of murder or homicide.

Very few places consider fetal murder a crime, and this that do,only apply it once the fetus is beyond the point of viability. It's important to note that killing of the fetus ALONE is not a crime. Fetal homicide is merely an aggravating condition added on to the murder of the mother.

a fetus is not a person .....doesn't matter.....judges give 2 life sentences...on appeal they get one life sentence
