Will his SO's income make a difference on child support?

My husband left me about a month ago for another woman with two kids of her own.  We have 2 kids together and I have custody of them.  I actually have an appt this afternoon to sign the divorce papers sob he can be served with them shortly.  But I was wondering since he immediately Moved in with her and she is now thinking of quitting her job would that have any effect on what he would have to pay in CS since he will be the head of household.  Or would it have no bearing whatsoever since they are not marriend and her childreb are not his. We don't have any CS figured yet (in the paperwork to be signed today) I just am trying to budget so to speak for our house their day care, their needs and didn't know if her status of e ployment would have any bearing on that or not.

The courts don't care at all if he is shacking up with a woman with kids. That has no bearing on his obligations to your children together. Child support is not based on what a person spends... it's based on what they earn.

Her income, his current state by his own choice, should not play a role in the support order. If the court suspects that he has done this, her quitting and such, just to lower his support, they can, and have, sent a message in past cases, that it will not be tolerated. If you can, get proof that she quite as opposed to being terminated, it may help you

if he quits his job a significant other isn't responsible. a judge will simply determine his earning capabilities and make a judgement based on that. if he remarried after your divorce and refuses to work and judge can use her income because they're married and he's willfully unemployed. but just cus they're dating she isn't taken into consideration. her quitting her job won't affect what he pays unless he again marries her and starts a new family,  the court will take into consideration that he has a new family if they have children together.

No.  Nothing she does or doesn't do has any effect on YOUR child support.

Yikes, what a slimeball. This will not effect the payments, his kids will always cost the same percentage regardless of how many he has or takes on.
