They both win and lose. Example: plaintiff says defendent cost me $10,000 by doing something bad. Def. says Plaintiff cost me $5,000. By doing something else bad. If the court agrees with both, they each win their claim but lose overall. Plaintiff gets $5000 when he was expecting $10,000, but Def still is out $5,000.
