Your neighbor "always 'has' dog out". Why does he have his dog out at the same time you go jogging?. Just to watch you jog by? oR does the owner even know his/her dog is out?

If the dog isn't under your neighbour's control (in a fenced yard or otherwise properly restrained) call you local animal control and inform them.
