damage claims for late delivery of shipments?
i think i have the right to demand for damages for late delivery of my air conditioning unit. i have electronic equipments running for almost 24 h. my old ACU broke down unexpectedly leaving me no choice but still run my equipments without the aid of ACU. what legal actions do i have to demand for my damages if theres any.
i believe the life span of my equipments will depreciate due to the condition.
i ordered and paid the equipment almost a month ago and it was stranded on the cargo forwarders side. they promised me it would be in my house 3 weeks ago
im absolutely sure its their delay. improper procedures or shall i say lack of manpower on their side and also warehousing.
3 weeks, i think is substantial enough to contribute defects to my equipments.
my satellite transmitter is now flickering which when i put electric fans towards it, the flickering minimizes.

It depends on the contract you have with them, AND ALSO the reason for the delay. If it's something beyond their control, ie like a work stoppage (strike), war (declared on not), weather, or government stopage of the transit (ie US government won't let the boat dock and/or unload at port due to security or legal issues, or the government won't let the truck/train/plane move for the same type of reasons) they'll probably get away with not being responsible for the delay. and thus not responsible for the damages.
As for claiming damages, you'll have to show that you have ACTUAL damages. Simply stating you MIGHT have damages isn't enough for you to have standing to sue for damages.
