Payroll law question?
Is it illegal for a company to not be able to pay an employee on payday? I work in Texas and yesterday was the third time this year that the company I work for has not had my check available on pay day. People come up on their days off and no checks. We are just wondering if there is any legal action that can be taken. Many peoples accounts go into over-draft because of this. They wil forget to pick them up or say oh the office people went home early. Etc. etc.

Legally, they are required to pay you by the 5th day following the end of your payroll period. Morally, they should tell you checks will not be ready on payday. My best advice, get another job. Sounds like they have financial problems.

It is ILLEGAL! You need to contact the Wage and Labor board in your area! Your employer is also ultimately responsible for the over draft fees as well.
If an employer has a posted payroll date, they have to give 30 days notice if that date is going to change!
Have all your documentation when you call. They will want details and plenty of infomation. You may also want to ask your co-workers if you can give their name and number to collaborate your story.
I have worked in payroll for almost 10 years, I know what kind of trouble an employer can get into for messing with peoples pay!

Same thing happens to me on a regular basis. We probably work for the same company. If you really feel the need, you could talk to the better business bureau. They will tell you your rights, if what they are doing is illegal, etc.
P.S. - The company should pay any overdraft fees/bounced check fees if you did not receive a check on payday. If they don't, complain.

It sounds to me like a cover up of some kind is going on. Like, maybe they are trying to "buy time" so there will be money in the bank to cover those checks. This is wrong. I live in Texas, too. I think you need to contact the Texas Employment Commission. Give them all the details you have and let them decide and guide you.

Yes it is illegal. Visit your states website for the producers that need to be followed.

legally they have to have them to you or in the mail to you by 5:00pm on payday. after that i don't know what you could do

It is not legal. You should report it to the labor board.
