How does it work to sue someone?

How does it work to sue someone who doesn't have money? I was in a car accident few days ago, the other party was at fault, and she doesn't have insurance. I have police report for the incident.

Right now, I have to pay deductible from my car insurance to fix the car and pay the co-pay for my hospital bills from my own health insurance. People said, I can take the person to court later and sue her for everything including my hospital bills.

How could I possibly sue someone and get my money back when she didn't even have money to pay her car insurance? I have not talked to the lawyer since I was just discharged from the hospital last night, but I'm going to get one on Monday.

I need some help/ explanation as to what to do next so I can sleep this weekend. Thanks.

    If you win your lawsuit, and if the person is employed, their wages could be garnished--a portion not paid to them but earmarked for you.

    The attorney you hire Monday will know lots more about whether the person would have to sell assets (like their car?) to settle a judgment against them.

    I had somebody without insurance who was drunk, on probation, carrying a weapon, carrying marijuanna smash my parked car. They fled the scene but there were witnesses, well the court system did the procedings and now he pays restitution. It sucks because you would really like to have the full amount now but for the past 4 years I get like $75 dollars every 3 months from this guy - they garnish his wages but not much of them, they take out the court costs before they pay the victim. It will take awhile for him to pay it all but that is how it will probably work for you unless the woman who did this has a lot of money.
