Whoo-hoo...Its almost tax time?
Hey I have a general question on taxes, hopefully one of you is an expert out there! WE will be going to HR block or somebody this year...Anyway, my fiance & I bought a house together this year in April, it is in both of our names, but I think he is the "primary" or something. I also have a dependent(6 yr old daughter) Can we both file head of household? he makes a little more $ than I, but I have the dependent. I am so confused on how this will work. Like I said, we will be going to a professional, but I was just curious if anyone has been in the same situation.

We are not married. When we bought the house, we didn't have to put any $ down, but I did supply the earnest $. Our taxes & insurance are included in our monthly payment.
Also---he sold his old house, which was in his name only.
one last thing---he pays the mortgage payment, I pay for everything else, both of our vehicles, groceries, insurance, phones, etc

In one household, only one taxpayer can file as HOH--that taxpayer must be able to show how he/she paid more than half of the total expenses...and that taxpayer must have a qualifying child.
Since this is your daughter, even if he paid more than half, he would have to file as single.
If you paid less than half, you would also file as single. You can still claim your daughter, child care, child tax credit and EIC (if appropriate).
When you bought the house, how much money did each of you put up? You take your itemized deductions for interest and property taxes using the same percentages (assuming you actually paid them). Your fiance's is "primary" simply because somebody's name had to go first. It does not mean he gets to itemize everything.

To file as HOH you must pay more than half the cost of keeping up the house for more than half the year and have a dependent. You have the dependent but since he makes more than you the second test may be a problem. Most people would do it anyway.

One of the requirements for filing as head of household is that you pay over half of the cost of keeping up the household for the year. Obviously you can't BOTH pay OVER half of the costs. You'd have to look at the total cost of keeping up the household and see who pays over half. If he does, then you don't.
Another requirement is that you have a qualifying dependent. You'd qualify on that test, because of your daughter - he wouldn't.
So it's possible that you qualify as head of household, but not unless you pay over half of the cost of keeping up the household. Without a qualifying dependent, your fiance can't file as head of household.

I'm an accountant....I assume you are not married. He should file "single" You can file head of household and claim your daughter as your dependent.
