Speeding ticket/court/license suspension?
Ok, I'm sorry that I an posting a similar question but I left out some pretty important details: here we go- I am 16 years old and live in Texas, I got my first speeding ticket the other night (with no1 on the road) going 75mph in a 35 limit (yes I have learned lesson and realize the stupidity)... Since this is my first ticket I have to go to court where the judge will decide the punishment, my friend says I will only be in there for 5 minutes but still..... I was basically wondering since this is my first ticket will I likely get my license suspended and what is the likely fine? Do I need a lawyer? And if I take defensive driving does it not go on my record and insurance?

the cop did not charge me with reckless driving, only speeding (some1 told me that my license can be suspended from 3 weeks to 6 months max)

Every municipality is different but at the very least you can expect a few hundred in fines as well as some points against your license. Here in Colorado anything over 20 is reckless driving which is an 8 point violation and you only have 7 points on your license between the ages of 16-18, so its an automatic suspension. Since its your first ticket you will probably be hit with a lesser violation( if your lucky, maybe only like 4 points), a fine(depends on the city, here the max fine for minor infractions is $500) and probably driving school because of your age. Count on your insurance going up, but the good news is if you report your driving school graduation to your insurance co. it should help lower your rates slightly. As for needing an attorney I would say no unless you really want to spend the money. If this turns into a serious court battle you can always appoint a city defender(lawyer) free of charge, but I doubt that would happen. First offenses the courts are usually leniant on. Do it again and they will nail you to the wall.
Update to your update: Doesn't matter what the cop charged you with - the judge can amend it. They do that alot where I live, often the charge against you at first is not what ends up on your record. Usually its part of a plea bargain. And the license thing is not right either. Your a minor which means they can take it until your an adult if they want, or if they wanted to, maybe even longer. Like I said, it depends on the area, just hope for the best.

"Defensive Driving" is a program for senior citizens to help them avoid getting into accidents caused by the reckless driving of other people on the road. There is a program called traffic school which is sometimes available in place of a speeding ticket. However, traffic school is generally for people going 15-20 MPH over the posted speed limit, it's not an option for people who went more than twice the posted speed limit.
There is no way out of this going on your record. However since it's your parents policy, they might not even check it at all (that happened to me). Even if they do, it might take 6 months for them to check your record again. Assuming you're 16 1/2 now and it takes them 6 months, you'll only pay high insurance for a year then it drops off your record when you turn 18. Just remember you won't be so lucky in the future and don't do it again.
Just show up and tell the judge you're sorry and you're not going to do it again. If the judge sees you as being respectful he will go easy on you. If you show up in court wearing a hat, don't look at him, don't speak clearly, etc. the judge is more likely to suspend your license.

At 40 over the posted limit, it's very likely that you are being prosecuted for reckless driving or driving to endanger. As a newbie driver, either of those can result in a suspension of your license, as long as until your 18th birthday. Based upon the speed alone you're looking at about $500 in fines plus another $500 in surfines and court costs. Even though the cop only cited you for the actual speed, the prosecuting attorney or DA can choose to prosecute the more serious offense. Figure double the fines if they do.
You really NEED an attorney in this case. This is not a simple moving violation but potentially a criminal complaint.

Honey at your age it goes on your insurance no matter how many driving classes you take to try to make good.
I think your license will be suspended until you are 18, a legal adult.
I think your fines will be very, very high as you were going 40 mph over the posted probably in the thousands to include court costs and you won't get your license back until your fines are paid
Your driving record is your record for life. It's not wiped clean when you're 18 because you are under age right now.
and what does, really, no one else on the road have to do with any of this? someone was on the road though, the cop!
but then again you are in TAKSUS aka TEXAS where this kind of manly behavior is encouraged so you may just be in court for the judge to praise you on your leap into texan manhood

At the judge's discretion, your license could be suspended until you are 18 years old. He will see you were going 40 miles an hour over the speed limit.
I can't even imagine how much your insurance will be going up, first ticket or not. You actually have not had your license very long.
An attorney would be advisable.

35mph over the speed limit is considered reckless driving, in CT where i live you can be arrested for it. I'm not sure about Texas. Usually on your first court appearance for a speeding ticked you will get a lesser fine than what your ticket was originally written for. Good luck

Depends on the judge...Some judges like to give stiff fines for young offenders to teach them a lesson...
Most likely your insurance will go up....

You would spend time in jail and lose your license for 12 months in my state. Then get fined.
