Is the cost of day care/preschool already included in his weekly child support payment?

My ex's pay me weekly support payments, so he doesn't have to pay one large bill at the beginning of each month. Now that my daughter is about to turn 4, im going to enroll her into a preschool. I was wondering if the cost of preschool was already included in the child support payments he makes? I have never asked for any additional money, for daycare before, and was wondering if I have to go back to court to receive some of the cost from him? Also, being that we dont share custody, and he has never seen her, how much of a percentage (if any) would he have to pay?

BTW, we live in Orange County, California. And he has currently been charged with "contempt of court", for non-payment (if that matters).

    I commend you for being a good father and willingly providing for your child. Let's say that you give a total of 300 per month to your child. That's 75 dollars a week. No, my man, that is not enough for your child to live on. That's just enough money to cover food, clothes and a few extras. If you have any extra money, then try to help your child. Don't give your ex the cash. Just pay for the baby sitter and some of the dance classes yourself with a check or money order. And if your income decreases, your child support checks will be adjusted by the judge.

    No, you will not get anymore money. In order for you to receive more money he would have to have a "substantial change in income". Other wise the current court ordered amount stands. You do not get more for her because your costs increase. You are required to cover what the child support does not as its your job as her mother.

    Child Support payments are calculated on the non-custodial parent's income NOT the custodial parent's costs. You can only have a CS order increased if his income has increased. He doesn't sound like a real hard charger.

    If you want the amount of child support revised you must go to court to do so, for whatever the reason. If he is having difficulty paying for some reason or you are having trouble collecting, all the more reason. But he isn't going to be able to pay anything if he winds up in jail.

    The judge usually considers the status as is. You can go back to him and explain what you intend. He may raise the amount or he may not.
