Has anyone stopped to think that mandatory health insurance actually violates the 1st amendment?
Let me be very clear. It actually infringes upon the rights of Christian Scientist believers freedom of religion. It also infringes on the freedom of religion of the Amish. The Christian scientists do not believe in modern medicine and actually believe it to be idolatry. They believe only in the power of prayer. The 1st amendment guarantees them the right to worship as they see fit. The Amish forsake everything the modern world holds dear. That includes our fancy medical gadgetry. Its more the Modern part of Modern medicine they do not like. As is their right. However if this bill passes there will be a penalty imposed on anyone who does not carry health insurance. Why would someone who does not believe in medicine carry insurance? Why would someone who lives through barter need insurance? Many Amish pay for medicine and doctor visits by bartering goods for the doctors services.
Also we are guaranteed the right to pursue happiness as we see fit as long as it does not infringe upon the rights of anyone else. There are plenty of people who feel no need to carry insurance. They prefer to pay as they go. And in many cases these are very healthy people who maybe need to go to a doctor once every couple years. So they hit the ER and make payment arrangements. This would be illegal under the proposed bill. So not only do we have an infringment on the freedom of religion, we have an infringement on the pursuit of happiness.
Guru, actually in a few states Alabama being one of them, if you make over a certain amount of money per year; each state is different, then you do not have to carry car insurance. For instance in Alabama the yearly amount was 500k. Good try though.
Pj, Hi welcome to reality. I did point out that as long as my pursuit does not infringe on anyone elses rights. Drunk driving would probably end up with me killing someone. and that puts a pretty big damper on their pursuit of happiness.
And forcing parents to get medical treatment is also wrong. If the child wants the medical treatment the parents should be forced to abide that. However if neither the child nor the parant believe in the medicince than the government needs to get out of it.

Sunflower I am not sure where it is you live, but in America car insurance standards are not set by the federal governement but instead by each state. Hence why when I moved to Colorado it was a no fault state. Meaning No fault was ever assigned in an accident. each persons insurance simply paid for their car. And it was awesome it was super cheap, and worked well. If the other person did not have insurance I was still fine because I did. The only person he hurt was himself. It was a great system, and we were duped into voting it away.
Sunflower. Yes accidents do happen, however we do not require the Amish to have car insurance because they do not have cars. Why would we require people who would never use it to have health insurance. We are penalizing people who do not carry insurance. How is this american? I was raised in the United States of America. If you want to be a moron that is your right as long as you don't infringe on mine! We are free in this country to make mistakes, to fail, to try, to do whatever we want and to learn from our mistakes. We have never needed to governement to hold our hands and tell us what insurance to get, and force us to do so. We still do not need that.
Logicali...actually all of the things you say we can't do are exactly what made this country wonderful. If the government took a families child away because they are an athiest, we would all be up in arms to defend their civil liberties. The ACLU would have a fit. But if someones civil liberties are being threatened and that person believes in god, and is not a muslim, you call it brainwashing. Just like the ACLU. A persons religious beliefs differing from yours is not brainwashing. It is simply a differing point of view. When we overlook the individual in favor of the "greater good" we have actually lost everything that makes this country grand. "the greater good" is exaclty the reason our fore fathers fled their home lands and came here to start this country. "The greater good" was the enemy called communism for 50 years. "The greater good" destroys the things that make this country great. I will stand against the greater good.

I feel it no more violates the first amendment than mandatory education does. Healthy bodies are just as essential as an educated mind. If a religious fundamentalist believed that formal education went against their faith, should they have the right to keep their children out of school (without an approved home schooling curriculum)?
Furthermore, the pay-for-services-as-needed scenario you propose is a far cry from the reality of the situation. The majority of uninsured people who require emergency care do not happily set up payment arrangements with the hospital's billing center.
Although the patron of a family may have made the misguided judgment that health insurance isn't a necessity - why should his or her children have to pay the price of this ignorance? Approximately half of all chronic diseases are linked to preventable problems. Preventative care is a crucial element for combating more serious (and expensive) health problems that occur later in life.
And it is ludicrous to say "well, if the parent and children don't want it...they shouldn't be forced to have health care". If the children are brainwashed by their parents, of course they'll say they don't want health care. A child is not capable of understanding the severity and consequence of that kind of decision.
And finally, although it sounds nice in theory for an adult person to have the power to opt-out of health insurance - the reality is that, 90% of the time - at one point in their life - they will require professional medical attention. Out of the 90%, I would say over half will not have the financial means to pay for those services, which means the government (ie: you) inevitably ends up paying for it anyways.
Yes, there still may be a tiny group of people who will never need or want medical care throughout their lives....but they are far out-weighed by the majority. A society cannot cater to every niche group. It just isn't possible.

actually, no it does not...
just because someone is made to have health insurance (and that is not what most of the health bills in Congress right not do) that does not mean that you need to go to the doctor....
just like you can be made to have driver's insurance even if you decide that you do not want to ever drive...
some people get it just so that they can drive in an emergency, or so that they can own a car for said emergencies...
no one in America can pay as you go with drivers insurance no matter how wealthy they are...no one is given the choice because everyone realizes that emergencies happen and that those costs are catastrophic...the same goes for health insurance...cancer could put someone in the hospital for years, requiring surgery after surgery just to maintain life...there is no way that anyone is going to pay as you go in a situation like this...the result would be for American taxpayers to have to pay for it...that is a bunch of crap...If I am going to have to chip in by paying taxes, I would much rather allow for regular doctor visits which are much cheaper because then they may have caught the cancer at an early stage and eliminated much of the wasted costs...when people don't have insurance they only go to the hospital when things are so bad that it costs more money...

Part of the problem with our health insurance system is that those that don't carry insurance get in things like car accidents, are taken to emergency rooms, where they receive the most expensive care there is and then THE REST OF US pick up the tab.

Sure. Mandatory care insurance exists. The christian scientists and amish are free to bring their suits as high as SCOTUS.
Since parents can be forced to get medical treatment even in the face of their religion -- the point is lost.
Freedom of religion is not freedom from Article 1.

I positioned myself someplace to the left of Karl Marx and that i do no longer safeguard mandatory scientific assurance or mandatory id tests. Imho, the only sane answer to our rotten U.S. "well-being care" equipment could be a single payer, socialized, medicare for all style equipment. yet, that decision became into taken off the table formerly the table became into even set up. For that count number, i do in contrast to motor vehicle assurance or any style of inner maximum assurance. think of approximately it. i will provide my funds, each month or six months or regardless of, to somebody i don't be attentive to to hold for me till i like it. Then, i will ask him for it and he will provide it back. Duh. primary multinational firms have had ninety 9% of the human species via the balls for the reason that Eisenhower and have been squeezing greater durable and greater durable for the reason that Reagan.

You don't even understand the Constitution. Go back to school.
Perhaps paying taxes infringes on your pursuit of happiness. Or laws against drunk driving and drug use. Or a million other things.
