The death penalty questions. 10 POINTS. PLEASE HELP?
ok so i have to answer these questions for my government and economics class and they have to be 6-8 sentences long. please please help me. greatly appreciated.
1.) Is using the death penalty against minors a violation of crul & unusual punishment?
2.) Is using the death penalty against the mentally ill a violation of cruel and unusual punishment?
3.) Is using the death penalty for those who committed child-rape violate cruel and unusual punishment?
please give me info. i really need help

Here is what tht US Supreme Court ruled:
On the first and third questions the answer is yes. On the second, the answer is no.
In the case of Roper v. Simmons, the Supreme Court decided that it is cruel and unusual to execute someone for crimes committed while under 18 years old. Link to the decision at http://deathpenaltyinfo.org/juveniles-and-death-pe...
People suffering from severe mental illness can be executed as long as they are sane enough at the time of the actual execution to know what is happening. In fact, in at least one case, a man with schizophrenia was forcibly medicated to make him sane enough to be executed. The appeals court said that the only unwanted side effect of the medication was the death of the "patient." (Case of Charles Singleton, executed on January 6, 2004 in Arkansas)
The Supreme Court ruled that it is cruel and unusual to execute someone for a crime which did not result in the death of the victim. (Kennedy v. Louisiana, decided June, 2008)

First of all, when a violent crime is committed, the courts go to great length to determine the persons mental age. When a 15 year old commits a brutal murder, then yes, they should be subject to capital punishment.
If a person has a long past history of mental illness, and commits a serious crime, my question is, what part of our system failed to detect this individual as a threat?? I don't think they should be put to death, but at the same time, a criminally insane person is a loaded gun waiting to go off.
It is up to the people to decide and push for laws to protect people, If child rape makes the list as a capital punishment crime, like it is in some states, then so be it.
We have a problem in this country that people are not held accountable for their actions. This is wrong, we act with a free will and a logical mind. If you commit a crime, you should do the time, or, in certain cases, be put to death by lethal injection.

Is it a textbook Q, or a self thinking Q?
If it's self thinking,
1) A child would not know the proper way to act, so should they die for something they could nott and did not understand.
2) The mentally ill are just that, mentally ill. so just like a child, they need to be taught. It may take more time, but who really deserves to die?
3) Though they have committed a serious crime, would the child want the person to die.

Personally, I'm glad I don't have to make that choice. If I was to make a choice I wouldn't use Dp in the first example. The second example would be on a case by case basis, and in the third I definately would use it

Minors don't get given the death penalty-UNLESS they are tried as an adult. Which is rare.
Yes, usually various tests are performed.
