The fact that one driver has no license and is hit by another driver does not relieve the at-fault party from liability. In some states, the driver with no license may be limited as to what he can sue for.

Anyone can sue anyone. That's just how the legal system works. Whether or not you will win is a different story. An unlicensed driver suing someone for a car wreck is pretty ridiculous, and getting a judge to agree would be nearly impossible. But hey, people have done dumber things, like getting behind the wheel without a license or riding in a car with an unlicensed driver.
