How can a State's National Guard be deployed to foreign soil?
Isn't the National Guard a State's exclusive militia under the authority of the State Constitution and Govenor? Would the State have to declare "war" for foreign deployment? and does the State have the power to delegate authority and control of it's own militia to the Federal Government?
My sister-in-law is in a State's National Guard, she is NOT in the Reserves, and she is to be deployed to Afghanistan next month.

The National Guard is a state force first but they are also reserve forces of the federal government (that's why they are either the Army or Air Guard) - technically a governor of a state could refuse but doing so would cut off all federal funding for training and since the feds pay somewhere along the lines of 90% of the funding for the guard they would be insuring their force is ineffective.

No. read the constitution (and understand this is WHY the 2nd Amendment does NOT imply that the right to bear arms ONLY applies to "militias")
I added the capitals since we can't bold....
ARTICLE II
Section II
The President shall be Commander in Chief of the Army and Navy of the United States, AND OF THE MILITIA of the several States, when called into the actual Service of the United States

Because there's no such thing as state's rights anymore. It's pretty sad in my opinion. We're all beholden to the whims of the federal government. Even though I live in NY, the people of California have a say over how the people of my state are legislated. Sucks.

the national guard is the state army. however they allways train with regular army and can very easily be integrated into regular army as needed. when troops are deployed to battle overseas over 70% of them are national guard.
Source(s): i was in New Jersey Army National Guard. There is s sttipulation when u sign up (among many) that states that. You can be integrated into the regular army at any time/ as needed . (11C) - Anonymous1 decade ago
