Does someone in my family have the permission to become the legal guardian of my nephew?

My sister went to prison for domestic abuse against her boyfriend and the custody of my 4 year old nephew went to the father whom my nephew barely knows (he just got out of prison), we haven't had contact with the kid since then and he is possibly upset, we can't tell because the father doesn't let him communicate with anyone from our side of the family. Is there anything we can do to gain custody of him ASAP? He is closest with our side of the family and it would definitely be best for him to be with us. Thanks for any help!

    Sorry to be the bearer of bad news, but unless you have "smoking gun" evidence that the father is an unfit parent, the state will not take his son away from him under these circumstances.

    If other family members wants guardianship of the nephews, they would need to file a motion in family court..that would need to consult a lawyer on this

    Talk to a family law attorney.Could be his dad is trying to straighten up, but if he doesn't then you can get custody.Try talking to the boy's dad and tell him you hope he is getting on his feet and doing better for himself.That you'd like to see your nephew sometime if he would allow it.
