Is Obama a goniff for stealing the phrase "Yes we can" from Sammy Davis, Jr.?

Of course Obama modified the phrase to "Yes we can," but wouldn't that be like Burger King advertising with the slogan "We're loving it!"--instead of McDonald's "I'm loving it!" Of course, Sammy Davis, Jr. died many years ago, so his Estate would have had to stop Obama from using the phrase. I believe that if Sammy were alive today he would have objected to Obama's use of his phrase. Sammy didn't like phony Democrats. In fact, they bothered him so much that he became a Republican, much the way his friends Frank and Dean did--and for probably the same reasons.
