Got caught shoplifting headband at walmart in ohio, how low can you get?

I would like to know what is going to happen to me. I took a stretchy headband and a pair of earrings. It added up to 7 bucks. They didnt call the cops, just tried to scare me by telling me how bad I am.. they put my information in the walmart computer and took a picture of me. The manager said he wanted to see me still shop there.

i left and was given a letter from walmart some civil thing? am i going to get fined or arrested?

    You can bet they sent your name is to the police dept. Now you are on their watch list.

    If they let you go then it sounds unlikely they will decide to press charges later.

    In case it might dissuade you from doing this again, the crime is a First Degree Misdemeanor and you could receive 6 months in jail AND a $1,000 fine.

    You should read the civil letter they gave you carefully. Make sure it says what you believe the manager to have said about returning to the store. Typically they give shoplifters a trespass warning and tell them they cannot return to the store for a year. If that is the case and you are caught in the store you can be arrested for trespassing even if you aren't doing anything else wrong at the time.

    They also have the right to sue you for "treble" damages. Meaning for 3 times the value of what you stole. Luckily in your case that is $7 and you would be looking at $21. But it can really add up if you take something worth $200.

    You ask two questions: (1) Yes, if you were handcuffed, you were arrested. In fact, the moment you no longer feel free to go, you are technically under arrest. (2) Being arrested and being charged are different, and certainly being convicted is different again. So unless the thing you signed was an admission of guilt, you don't have a criminal record. Life is easier if you just follow the law - stealing is bad and illegal.

    You may get a civil penalty which is a fine. Information will remain within Walmart. They will keep the information out of the public eye and on hand in case you get caught again (Then they will use it against you to arrest you if you get caught shoplifting in Walmart again). Nobody else will get your information. If you don't pay the fine they will come after you and may take you to court. The fines can be steep.

    You were given what is called a civil demand.

    They can sue you for the cost of the item plus reasonable court costs. If you pay the demand, no further action will be taken.

    If you don't pay, they can file a lawsuit in small claims court. This will be a matter of pubic record and available to employers doing a background check.
