Can car insurance not pay?

I was recently visiting a friend at his apartment. We heard sirens and looked out---and saw a car on fire next to my motorcycle. The car was totalled as was my motorcyle and another car had damage. The car on fire----his insurance won't pay---they say it was a mechanical failure---and they don't have to pay.

Thanks for comments---one problem is that we both have the same insurance with the same agent---relatively small town---it is going nowhere. My uncle is an attorney---I am waiting for him to return to town---he should be here in about 3 days.

    Not only do they have to pay they will pay. As long as the car that started the fire has insurance on it they have to pay. Insurance company's try very hard to come up with reasons not to pay a claim. They even hire people to come up with new reasons. If you keep calling them and say the words "attorney general" and "let me talk to your manager" a couple of times then they should do something for you. What ever you do don't make a claim on your insurance until you are certain that they wont help you. Mechanical failure or not, that's why we pay insurance. Your bike didn't have a mechanical failure so you should be paid even though the owner might not get paid. I wish that you said what insurance company it was so I can rule them out next time i'm shopping for insurance.

    Many insurance policies have specific language stating that mechanical failure is not covered. Turn this into your own insurance for a comprehensive claim.

    Simply turn this in to your insurance company. They will communicate with the other insurance company and if they cannot get payment from them, your damage will be covered under your comprehensive coverage with your own company.

    BTW, you have some other good advice here and some bad advice. I suggest you let your own company do the work that you "hired" them to do when you paid your premium to them.
