by order of the court has my son has my husband's last name? My son does NOT know my husband is not his father., now i have to get his passport but do I need his biological father's signature? what about if I don't know where is him?
8 years ago We went to court to change his last name so now my son has the same last name as my other kid and my husband, but in the birth certificate has the biogolical. bottom line ** the name of my husband is not in the birth certificate**

It depends on who has legal custody or residency order for your son, if you and your husband have it and your husband's name is on your son's birth certificate then you have no problem, legally you don't need the biological father's permission.
Whether you tell your son at a later date about his real father is up to you, on balance it's better coming from you than by any other source such as medical records.
