Checking For Smoke Detectors in Home?

I have a family mem ber who refuses to put a smoke detector and the soon to be required CO detector in there home in New York States. I was wondering if a member of code enforcement or a fire inspector wanted to check for compliance are they allowed to check for that without a warrant.

    They will not enter the house to inspect it. The only way that would be enforceable is when the house is inspected after it is sold or rented.

    However, if there is a fire with no smoke detectors your (his) homeowners insurance may refuse to pay for the reason that the law requires them and that the damages may have been far less had they been installed and properly maintained.

    I don't understand why anyone wouldn't want to check their smoke detector. Why put up such a fuss about it? If the person is renting, the landlord could probably see to it that they are working properly. They are suppose to have working smoke detectors.

    Unless this is rental property they are going to have problems with the U.S. Constitution. Several laws have been revoked when tested in court.

    Searching a private home without probable cause and a warrant is not going to stand regardless of the good intentions.

    If there are children in the home, then YES. They are allowed.
