How can the U.S. Federal Government claim they have jurisdiction?--?

over the illegal law-breakers that are flooding into Arizona?----The Constitution of the U.S. gives the immigration and naturalization authority of people that want to immigrate to this country to the Federal Government.----but there is nothing about illegal immigration in the constitution because that is the problem of the State because lawbreaking is in the domain of the State within which the laws were broken. Would like to know wherein the Feds get the authority to even to suggest otherwise.

Do not tell me about Immigration because that is not the problem.

Update:

That Old Guy---take your own advice and re-read. "Upon Application of the Legislature or of the Executive",

The State has the duty to be 1st in line to protect it citizens and did so before there was a Constitution.

The 14th Amendment under which the Feds are claiming jurisdiction came way after the states were in the law enforcing business. Hello if these law breakers are not applying for entrance to the U.S., the Feds have no jurisdiction under any stretch of the imagination.

Update 2:

Bflowing---you need to read the 10th Amendment----you try to make us believe this is a National Government and not a Republic

    many states are now altering thier constitutions because of the continous refusal of the fed to enforce the laws on its books. The question is why is the fed refusing ,, who is pulling that string.?

    This remains the best and most free country on earth but liberals continue to drag us into the toilet and we soon wont be the best.

    I guess it really depends on what you mean by illegal law-breakers. If they break the law while in Arizona, then they come under Arizona authority. (Except of course, for Federal crimes.) If the only law they broke was to enter the country illegally, then that is a Federal matter, and not the State.

    And no, the State is not 1st in line, the Federal Government is. The Constitution supersedes whatever came before it.

    Do yourself a favor and reread, in the Constitution:

    Article 4, Section 4: which allows the Congress and Executive branch to protect the states from invasion of foreigners;

    Otherwise, I do not understand the question.

    EDIT:

    Is this not an application?

    The controversial SB 1070 law was meant to get the attention of the federal govt, as well. And it was an action of the state.

    Citizens rights also may not be infringed upon or denied under the 14th amendment, although there has been an effort to overwrite that aspect of it.
