Can i claim my girlfriends son on my taxes?
He has lived with me the whole year and I supported him. He is not my blood child though.Im pretty sure I can claim him but can I claim him as a son?

If your girlfriend files and claims her son, you can't. if your girlfriend had enough income to have a filing requirement, you ALSO cannot claim her son.
If your girlfriend made less than $9350 and agrees to not claim her child AND you can prove that a) he lived with you all year, b) the child made less than $3650 and c) you can PROVE you provided more than half of his support, then yes, you can claim him as a dependent under the "qualifying dependent rules." You do NOT qualify for HOH, child tax credit or EIC. Your relationship is OTHER or NONE.

If your girlfriend can claim her son, generally you will not be able to do so. If your girlfriend cannot claim her son and no one else is qualified to claim him, you may be able to do so. Even if you can claim him as a dependent, you cannot claim him as a qualifying child for purposes of earned income credit, child tax credit, etc. since you have no biological or legal relationship. He would simply be a dependent, not a qualifying child.

I know for a fact you can claim to have a "qualifying child" and take the Earned Income Credit. (People are actually able to take this credit "without a child" but many people are unaware of that. At least that's the way it was in 2009. May want to look it up!).
You can find all the tax instructions, laws, copies of forms, and anything else you have questions about at www.irs.gov.
You may be able to claim him as dependant, but I think your other poster is right--I don't think you can claim him if someone else already is.
HOWEVER, maybe you can claim Head of Household, and take the Child Tax Credit?? Just a few things to look into to see if taking care of GF and her son qualifies you for these!! Good luck and check out www.irs.gov.

You can't claim him as a son, so no child tax credit, EIC, head of household, or child care credit. If his mom had income under $3650 total for the year, you can probably claim him as a dependent though.

Your girlfriend has to claim her child on her taxes unless you are the parent of that child. If you claim a child that you are not allowed to By LAw, you can get into a lot of trouble from The IRS and have to repay what you should not have gotten.
Read the instructions on Filing and Claiming Dependents on your taxes It is found online at WWW.IRS.GOV and in the instructions book that you for the form 1040.

You definitely cannot claim him as a son, unless you legally adopt him.
If any other person, in the entire world, can claim him as a "qualifying child", then you cannot claim him at all.
If no other person, in the entire world, can claim him, then you might be able to claim him as a "qualifying relative".
