Labor Laws? Company policy, employees given bonus for years of service....?

My friend was employed five years with a company. Gave two week notice she was leaving for a better job one week before her fifth anniversary of employment. Should she still receive a service bonus? The usual $100. per year served given to all employees? If not, wouldn't it be discrimination of some sort since she did not receive it before she left ?

Update:

She WAS employed there for 5 years and her bonus would have been $ 500. Her timing stinks, I agree,

but she did work a week beyond her 5th anniversary. She seems to think it wasn't worth waiting another week to give her notice.....on to better things !

Too bad !

Nope. If she is leaving the company, they are not required to give her a bonus. Unless the bonus is defined in a contract, it is purely voluntary on the companies part and used as just an extra incentive.

If the 100 would be that important to her, she should have waited until she got the bonus before leaving.

Bonuses are incentives. If your friend feels she deserves the bonus she has entitlement issues that she may want to work on. It sounds like you get a bonus for every year you work. She didn't make it to her 5 years, therefore she doesn't qualify for the bonus.

No, its not discrimination in the slightest. While people may feel things are unfair, it doesn't automatically make it discrimination. I'd suggest you look up the protected discrimination classes before you throw the word around.

No, not necessarily. Bad timing on her part. But, its $100 per year! Better to move on. Not worth a second thought.
