If i write a check to someone but do not have the funds do it get deposited in ther account?

if not what happens

    If you intentionally or knowingly write a check for more than you have in your account that:

    1. It is a violation of 'hot check laws' (can be fined 500 -5000 or jail)

    2. It is a commission of a fraudulent act-again can be sent to jail

    3. You can be charged fees by your bank for the 'bounced' check, most charge $35.00 - 50.00 per check

    4. Your payee (person you 'paid') will have the check bounce in their account, causing them a similar bank fee.

    5. If you don't clear the matter immediately (paying all fees and the amount of the check) then you can be charged in court, and a warrant will be issued.

    IF you have overdraw protection, that means the bank will 'loan' your account the funds, but you would be charged for it according to their contract for your account. In addition you only have 1-3 days to pay them back (deposit enough to cover the check and fees). Or the bank can press charges in court for re-payment.

    No, the check "bounces."

    If someone deposits it in their account, the next day when the bank finds out it's no good they take the money back out of their account.
