Returned Deposited Item for 'Expired' Check?

I deposited a check on Nov 9, 2012 that was issued on May 15, 2012, and was void after 6 months. My statement shows a "Returned Deposited Item" for the check on Nov 16, 2012 (after expiration) and $12 fee charged 3 days later.

Is there any recourse for the refund of the fee since I deposited the check to the bank before the expiration day?

    Checks are valid for 180 days (Kerry is wrong), commonly referred to as 6 months. But business, and banking in particular, usually works on "days" (either business or calendar). And 6 months is technically more than 180 days. Banks can, at their discretion, cash a check that is over 180 days old. But if the check has "Void After XX (60,90 or 180) Days" written on it, the bank has no choice but to decline it if it is submitted after the limit.

    So, even though you deposited it in your bank on Nov 9 (a Friday), it did not "hit" the issuer's bank until the 13th or 14th. The 180th day was 11/10/12. So, technically it was "stale".

    You have no recourse because the bank acted within the law.

    You can argue with the bank about this all you want. It doesn't matter who is technically right. They have all the leverage. Do yourself a favor and find another bank.

    I once had a similar situation where I had my bank call the issuer's bank to make sure they would honor the check. The bank with the money against which the check was written confirmed they would honor it. My branch bank accepted it. It was then held in "limbo" for a while by my bank's processing department which then turned around and "returned" my deposit (erased it) and charged me a nice $35 fee plus other overdraft charges. That was National City, and I still get a warm and fuzzy feeling thinking about how they aren't around any more!

    If the 21 days is the legislation, then with the aid of law they don't have the correct to gather. Ensure you read the lease very carefully as good. You should contact a attorney about this matter.

    checks today need to be deposited prior to 90 days under banking rules

    vs the 6 mos you may have shown or was shown...have run into this before

    and issuer has not changed the woding on the cks...you can talk to the bank

    about it but believe they'll tell you it has essentially under the rules, expired.
