can custody be obtain?
me and my ex live in NYC, we have joint legal custody, and she has physical custody, and i have her my 6 year old daughter every other weekend.So yesterday my ex called me telling me to get my daughter and her because she had a big fight with her parents.so i went, as they were stilling arguing her mother attack her and they fist fought, so i broke it up, the cops came etc but my ex didn;t press charges..
So i took my ex to her friend house..and my ex does not want to go back to her parents house, and she will be living at her freinds, so i told my ex im willing to stay with my daughter and take her to school which is like 7 mins away, in which where my ex is staying is pretty far from there to the child school. and willing to let her freind take her to school but i disagree...and my ex works full time and she has the weeknds off, so i try to talk to my ex but she being stubborn about the situation, so can i go back to court and file for physical custody???

You do have grounds to seek it and with the police report in hand (to bad charges weren't filed) you have a fair chance of getting it. The mother isn't in a stable home and the previous one had violence. Once you are fit in the eyes of the court then it should be granted.

You can always try, now that you have a case of domestic violence even though there were no charges pressed there should be a police report, in which case you need to get a copy, as violence in the home of a child is highly frowned upon in today's society, and you have a strong case provided you have no history of violence, at least that's where I'd play my hand,
