Legal question about children and mail?
I need to find out if there are any laws that would prevent a father from sending mail to his children. ie, the children live with their mother, she wants no contact with the childrens father and is keeping the kids away. He cannot afford to take her to court (she lives in other state, travel back and forth is too expensive) and she's told him not to write to the children. Can he get in trouble for writing anyway? Visitation, custody and all that has never been addressed in court.
He pays child support. That was addressed in court. Court is not an option. Because of the amount of child support being paid, he doesn't have the money to take her to court. My only question is - is he breaking any law by sending letters to his children after their mother said don't. We are aware she'll probably intercept them and throw them away, but all we need to know is can she legally say "don't send your kids letters."
She knows he wants contact with his children. Both he and I have talked with her. Her story changes from wanting him in their kids lives to not. She ... has issues of her own. I can only speculate on why she plays the games she does and how she doesn't see that he games will eventually come back to bite her in the butt when it comes to the kids.

No, he can't get in trouble for sending mail. No court is going to consider that unreasonable unless there is a restraining order or the letters contain inappropriate material.

As long as there is no court order barring his contact with the children it is completely legal.

If a court has not taken away his visitation rights, he has rights to visit and write to his children.

Tell that lady to quit keeping her kids from thier father. At least he wants to talk to them.
