What can be done about this?

My fiancee's ex-wife had his childrens names legally changed. She went to a lawyer who said all she had to do was put an ad in local paper and that if her ex-husband did not respond, she could legally change their names. She put the ad in a large metropolitan paper in a city in a State where he did not live and proceeded with the name change. Is there any legal action he can take against her for having done this and can he force her to change the childrens name back?

    uh.......most jurisdictions have very specific rules about what publication requires if service can't be obtained. Most require publication in the local daily paper in the city where the respondent last resided. If you hire a lawyer and make a case that no one attempted to serve you and the publication was fraudulently executed, they may well over turn it.

    Edit: If you have to ask what can be done, you probably don't poses the the legal experience to pursue this. If you really want to try, start with the county clerk where the name change petition was adjudicated, and get the forms for a review/appeal. Might also try a local father's rights organization to see if they have staff to assist on this.

    People do stupid things after a divorce. I thought about the fact of changing my previous married name back to my single name, but it would be confusing to my daughter. But when/if I remarried, then the same holds true, since 2 different names.

    If this really happened and (IF), not done properly, then you can have the names changed back.

    Make an appointment with a family lawyer for legal advice. Most will give 1 free consult. IF, not done properly, then maybe the lawyer can force it back and also make them pay the lawyer fees.

  • Smells like b.s. to me. He would have to have a registered letter sent to him, notifying him of the change. If it is girl names he changed, so what, when they get married, their last name will change anyway, but if its a BOY, I would get an attorney, that is his last name, it is to be carried on, UNLESS the boy wants it changed when he gets older for some reason.
