What is the penalty for horse theft IN OHIO? Is it still a hanging offense?
I know that in Texas it is still a hanging offense.

There are no hangings in Texas as another poster stated. Stealing a horse is not a capital offense. Many sites will say an old law is "still on the books". This is almost always never true. For crimes like this (theft) there is only one "book", that is the penal code. No where in the penal code is theft of a horse a capital offense. It is just theft, punishment based on value of the horse.
There are hundreds of supposedly "strange" laws. These are just rumors, or extreme narrow examples of a certain statute. Example:
It is illegal to walk your lion on the sidewalk on Sundays without a license. It is illegal in Texas to possess a lion without a license issued by an animal control agency. So even though it is correct to say that you can not walk your lion without a license, that is not what the law says.

Hanging is no longer used as a punishment, even if it is still on the books. Some states like Texas have the death penalty, I think it is by lethal injection, but it is reserved for murderers. You would probably get jail time for horse theft.
