How long can you wait to charge someone for physical abuse?
A friend of mine had been physically abused by her ex boyfriend. It happened about 6 months ago or maybe a few more. Shes going to take him to court soon for other issues and was wondering if she could still press charges on that. She had witnesses of the incident and didn't provoke him in any physical matter.

I believe the statue of limitations is 5 years, but it gets hard to prove especially is there were no police reports or photos taken. The lawyer could say that she is making it up in light of whatever she is bring him to court now on. I mean really, why would someone wait if they were being physically abused? That would be their argument.

I think even 6 months makes it really hard to press charges for that but if it relates to the other things she is charging him with - she could possibly use those witnesses and bring up the abuse during the other case.

There will be questions why she waited so long. And if she's taking him to court for other things, her credibility and motivation are going to come into question. Trying to "press charges" over it can backfire. Depending on what else she's doing in court, she may simply want to bring it up alongside.
