Is this considered discrimination?

I am a sub currently working for a school district. I was working to receive a contract. I was told to work as though I had a contract. On 12-06-13 I was told I would not get the contract. Never was any circumstance brought up that I was not doing a good job. In fact I was told at meeting that I held and in my daily duties that I was doing "very good".

At the meeting when they told me that I was not going get the contract they said brought up a few things that they could not specify that I had done wrong. Behavior management, they said I lacked experience. I am a first year teacher but I was learning every day and I was following school procedures. I felt in my heart I was doing very well. Especially since I was subbing for an ebd class.

They said I didn't take to heart the ebd support person advice. This also is not true we had many meetings and I rearranged my whole day to fit in what we wished me to do. That's it. They ended with I took too many days off. I had 5days off. 2 were because I was sick and 2 were from when my grandma died. The last day was for medical appointments. In regard to this.

And I did not bring it up they stated: WE HEARD YOU WENT TO A MENTAL HEALTH FACILITY? I told them yes I went for an ADHD appointment and I have documentation for it. (This was four days before the meeting) they told me that I had taken to many day off, which wasn't true because teachers are contracted 10 plus bereavement. Furthermore why would they bring this up at my meeting anyway it's against HIPPA to be doing so isn't it?

    You are not contracted, so not entitled to 10 days off. You should have only taken the 2 sick days, none for your grandmother and made your medical appointment when you were not working.

    They are not your doctors, HIPPA does not apply to them.

    They have to hire someone. That means they will not hire a bunch of others. Picking someone over you is not illegal. It is only illegal if based on a protected class. Not likely your behavior is a legal reason not to hire, as is lack of experience, or not following the advice given, as well as excessive absence.
