Company may sell facility before or during pregnancy leave (CA) or layoff... What will this mean for me?

So I am a nurse at a small hospital that is part of a chain of hospitals. They have been trying to close us or turn us into an outpatient center or rehab facility for many months now but were unable to because the city wouldn't allow it (This is all confirmed as true). The latest rumor though is that they are now trying to sell our facility. If any of these happen I don't know what this will mean for me. I don't know if some or all of us will be laid off or if we will be transferred to one of their other hospitals.

To further complicate my issue,...

Update:

(continued from above)

... To further complicate my issue, I'm pregnant and plan to go on maternity disability leave on march 1. How will this affect my disability if I am laid off? What about my health insurance? I don't want to be without insurance and go into labor. I am the sole income, so I'm assuming I would qualify for medi-cal right?

If they sold while I'm on leave under them, would I then still be their employee (since I'm on leave) or would I automatically be an employee of the new company (assuming we didn't get laid off)?

How will paid family leave be affected? Since I could possibly be a part of the new company, I'm assuming I then wouldn't qualify for it as I wouldn't be an employee long enough, correct?

Any other input or advice I may be missing is much appreciated.

How your employment changes if the company is sold while you are on leave, would depend on the specific terms of the sale.

    - you could be laid off by your existing employer (not part of the sale)

    - you could be transferred to another location by your current employer.

    - you could become an employee of the new company.

    - if you become an employee of the new company, they can lay you off or transfer you to another location.

Medi-cal = eligibility is based on income. It's going to look at your pre-leave income. If you aren't eligible today, you won't be eligible in a few months.

Leave of Absence = if you are not laid off, you will transfer your employment to the new employer. This would include transferring all benefits.

If you are laid off, you will be offer cobra insurance (the same insurance you have now only with the full premium - no employer subsidy).

California disability = if you are employed when your disability leave starts, any employment changes while on disability won't impact you until you are ready to return to work (you would continue on disability). If when you are ready to return to work there is no job for you, you would transfer to California unemployment.

California paid family leave = is not for pregnant women; you would be covered under California disability. PFL is for the care of family members or for paternity leave.

If they sell the facility, it will be up to the new owner as to which employees they keep. They don't have to keep anyone, including someone on maternity leave.

Any of these can be true. No way for us to know. You have to ask them. If you do lose your job you will be offered Cobra which is expensive. You will not automatically qualify for Medicaid.
