Difficult choice: Get a stranger out of a burning vehicle by causing shoulder dislocation, or leave her to alone in fear of being sued.?

The "good Samaritan" law is not always on your side when you deliberately cause harm.

Update:

Disregard the preposition "to" It is a typographical error.

It's not always easy to say what you'd do in an emergency situation. I can't tell you for sure what I'd do.

But I think I might try to rescue a person trapped in a burning car.

First I'd get her to sign a release, a document stating that we both know rescuing a person from a burning car is dangerous, even though I took all necessary precautions, and that she promised not to blame me for any consequential damages. Sign here. And here. And initial here. Stop screaming, I can't rescue you until you sign the form! 8^)

No, I probably wouldn't do that.

Let's face it, you're going to get sued either way. If she dies the family will sue you for not helping since anyone can sue for anything. You can be the guy who saved a life and got sued for it or you can be the guy who let someone die and got sued for it. It's a personal choice, do what you're willing to live with most.

My phone is stupid so my answer may come out un edited.

Yeah, I wouldn't put it past desperate people to sue over ridiculousness like this. However, I'd say a lot of Lawyers think of it this way, you cause a shoulder dislocation with some pain vs. her dying. Sure, there will be politics but I'd say it would just be thrown out.

How does the saying go? "Life over limb?"

I'd save them & argue deliberate harm later.

In a life or death situation.. I think it is assumed there is no DELIBERATE harm. There would be no time for debates.

Save their life and deal with their stupidity later.
