In Illinois, in addition to 12 weeks of time off from their place of work, are new mothers eligible to apply for unemployment benefits?

    You can't collect unemployment while on FMLA leave. In order to collect unemployment, you must be unemployed and actively seeking work. While on FMLA leave you are still considered employed, and you are not seeking work because if you were able to work and/or actively seek it you wouldn't be on leave in the first place. The purpose of the FMLA leave is for you to have a job to come back to when you are able to work again.
