Anything that he wouldn't do with you in the room can be considered cheating. As mentioned its disrespectfulo to you and by giving him a Hail Mary pass it could be seen as condoning his behavior. Maybe you should let him know that you know hes being doing that. Nothing quite like being caught in the act to reform his behavior.
