Hi I am looking for help on how to change a minor childs name in Los Angeles CA.?
My son is 3 and has his father's name. The father is not active in his life and only gives us problems like calling texting etc.
I tried the Torrance Family Court and the father was served papers on the name change so he showed up to have my request denied.
How can I get his name changed without his dad getting in between. By the way I have sole custody of my son.

You need the father's permission. Your request was forwarded to him and he denied it. He's entitled to do that. Your child's name will stay what it is.

It's not really your choice. You can negotiate with the father for him to sign off on the name change but that will probably mean releasing him from financial support for the child. May not be worth it...?

You can't a father has an equal say. Did you file for child support?
If you are the only parent filing a petition (request) to change your child's name - whether the other parent agrees or not - you will get a court date and you will have to let the other parent know about your petition and about the court date for the petition. If your child's other parent does not agree to changing the child's name, he or she has the right to oppose your request.
If the judge approves your request, you will get a court order called a "decree" changing your child's name. The court process can take up to 3 months, though in busier courts it may take longer.

If you were not married you had a choice, you named him. Now the father has rights.

It is done the same way in every California county. There is no way you can freeze the father out.

Offer to write his Dad a check.
You might have custody, but this doesn't mean you own the kid.
