Yes. You must ALWAYS be aware of what's going on around you and be prepared for anything.

My guess it yes because if they were it was unlikely the driver knew but it would be a matter for the police and insurance companies to decide what percentage that you or they are at fault.

It may help if you show them that, but you should still be able to stop. Usually if you tear end someone it us your fault. Really old cars dont need stop lights

probably. you MIGHT have a chance IF the other driver has run insurance scam before- or actually gets ticketed for defective brake lights. Southern California and New York State have some scammers that do the rear ended by inattentive driver claims- brake lights may have cutout switch, others have well adjusted hand brakes and pick some one using cell phone to stick with damage claims- officer gets call of rear ended, cell phone log shows time of use and 911 call time stamp makes it a inattentive driving, following to close and impaired by cell phone use- 3 tickets and insurance company won't fight claim, would try to settle before whiplash adds another $10,000.00 in medical claims . Absent some digging up other drivers possible record,, getting police to do vehicle inwspection for defective taillights, brake lights - you're going to be paying.
